The result? Multiple leg fractures, a meniscus tear, and a jaw injury. But what came next is what really matters: a $200,000 payout after the city failed to fix what it knew was a dangerous problem.

According to Cleveland News, the Parma Service Department had warned the city numerous times between January 2019 through to May 2022 of the need to repave Jeannie Drive.

Despite these repeated notifications, repairs were delayed due to pending sewer work. As Parma Service Director Tony Vannello explained, “It would’ve made no sense for us to pave the street and then tear it up to spend $500,000 on the sewer repair.”



But that delay had serious consequences. As Chief Prosecutor Scott M. Tuma put it, “It got to where this individual is riding his motorcycle and was injured on one of the potholes.”

Jeffrey and his wife, Renee, filed a suit against the city for personal injuries and property damage—and won.

“It’s a settlement of Jeffrey and Renee Porter who filed suit against the city of Parma in Cuyahoga County Common Pleas,” said Tuma. “The case... took us several months to litigate.”

The total settlement came to $200,000: $50,000 from the city and a hefty $150,000 from their former insurance provider, Tokio Marine.

Normally, the city might have been protected under governmental immunity—but in this case, the long trail of ignored warnings tipped the scales.

The city didn’t fight the outcome. “We do have an obligation to our residents when there is some liability that we have to take responsibility and make sure that the safety of our residents is first and foremost,” Tuma said. “So that’s what we did. We thought we did the responsible thing by agreeing to a settlement on this on this matter.”



Even Parma Mayor Tim DeGeeter stood by the outcome, noting the incident will change how the city views similar situations in the future.
