CVS-owned pharmacy declares bankruptcy after legal setback—what it means for customers

On Monday, Omnicare, LLC announced it was seeking Chapter 11 bankruptcy protection.

The reason? A jaw-dropping $949 million civil judgment stemming from a federal lawsuit.

The company is calling the penalty “unconstitutional,” and it’s not hard to see why they’re fighting back: that’s nearly a billion dollars—enough to make even a corporate giant’s knees buckle.

The lawsuit, originally filed by a whistleblower pharmacist and later joined by the Department of Justice, accused Omnicare of some serious missteps.

According to the allegations, Omnicare pharmacies dispensed medications to residents in long-term care facilities using expired prescriptions, assigned new prescription numbers without proper paperwork, and skipped required pharmacist approvals.

The government argued these practices led to fraudulent claims for reimbursement.

CVS Health, Omnicare’s parent company, has denied any wrongdoing, insisting that no patients were harmed and that everyone received the medications they needed.

Still, the court’s decision was clear—and the financial fallout was immediate.

If you’ve noticed fewer CVS stores in your neighborhood, you’re not imagining things. CVS Health is in the final stretch of a three-year plan to close 900 stores—almost 10% of its total locations.

The company says it’s adapting to changing consumer habits, focusing more on health services and digital offerings, and less on traditional retail.

Some shuttered stores are being transformed into “HealthHubs,” offering expanded primary care and wellness services. It’s a bold move, but one that reflects the shifting landscape of American healthcare.
