Why the lawsuit was filed

Whole Foods, known for its 365 brand of products, faced a lawsuit over the packaging of its 365 Organic Hot Cocoa.

The claim alleged that the company used misleading packaging with “non-functional empty space” that made the bags appear fuller than they were.

While Whole Foods did not admit any wrongdoing, the company agreed to a $650,000 settlement fund to resolve the case.

Shoppers in California who bought either of the following products between November 3, 2017, and March 13, 2025, may qualify:

  • 365 Organic Hot Cocoa Rich Chocolate Flavor Mix
  • 365 Everyday Value Organic Hot Cocoa Rich Chocolate Flavor Mix

How much can you receive?

The settlement will be divided among everyone who submits a valid claim.

The current estimate is about $2.90 per claimant, though the exact amount depends on how many people apply.

Filing without proof of purchase

For the first two products claimed per household, no proof of purchase is required.
