Popular clothing brand settles website lawsuit—some shoppers may qualify for cash

If you’ve ever struggled to navigate an online store due to vision issues, a recent legal settlement might be worth your attention.

One popular clothing brand is now facing consequences for website accessibility problems that affected thousands of shoppers.

As part of the agreement, eligible customers may be entitled to a direct cash payment—and there are multiple ways to claim it.

The total payout runs into the millions, and the deadline to file is quickly approaching.

Here’s what you need to know and how to find out if you qualify.

Why Fashion Nova is settling

The lawsuit accused Fashion Nova of violating disability rights by failing to make its website compatible with screen-reader technology.

This type of software is essential for many blind and visually impaired users to browse and shop online.

While the company denies any wrongdoing, it agreed to settle the lawsuit and improve its website accessibility as part of the resolution.

The case was filed under California’s Unruh Civil Rights Act, which provides strong protections against discrimination—including up to $4,000 in statutory damages per violation.

Who can file a claim

This settlement only applies to a specific group of individuals.

To qualify, you must:

  • Be legally blind
  • Have attempted to access Fashion Nova’s official website using screen-reader software
  • Be a current resident of California
  • Have done so on or after February 26, 2018

If you meet those criteria, you can submit a claim to receive a portion of the $5.1 million fund.

How much money you might receive

Each eligible person could receive up to $4,000, but the exact amount will depend on how many valid claims are submitted.

Fewer claims mean larger individual payouts.

More claims mean smaller amounts per person.

Either way, it’s a meaningful settlement for those affected.

The deadline is coming soon

To receive a payout, you must submit your claim form by October 20, 2025.

Late submissions may not be accepted, so it’s best to act promptly.

Help is available through the official settlement website or legal aid organizations for anyone who needs assistance with the process.

  • Zelle
  • Direct deposit
  • Visa (via email)
  • Paper check

There’s flexibility to choose the most convenient option, whether digital or physical.

Fashion Nova’s history with lawsuits

This isn’t the brand’s first time facing legal challenges.

In a separate case earlier this year, Fashion Nova agreed to a $2.4 million settlement with the Federal Trade Commission (FTC) after it was accused of hiding negative customer reviews.

According to the FTC, the company suppressed reviews with less than four stars, which misled shoppers about product quality.

That case resulted in refunds for approximately 148,000 customers.

Why this matters for accessibility

For many Americans—including older adults—shopping online is an important convenience.

But for people with disabilities, many websites remain difficult or impossible to navigate.

This case highlights the ongoing need for digital accessibility and equal access to products and services.

State and federal laws like the ADA and California’s Unruh Act are meant to enforce those protections.

The final approval hearing for the settlement is scheduled for February 12, 2026, but the claim deadline of October 20, 2025, is the more immediate concern.

If you or someone you know may qualify, be sure to look into it before the deadline.
